These Privacy Policy and Terms of Service ("Terms") govern your access to and use of the DEEPWERK web application, related websites, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Service.
1. Service Description
DEEPWERK is a web-based application that enables users to generate AI-powered images and videos based on user-provided inputs, including text, images, audio files, and voice recordings. User inputs are processed solely for the purpose of generating the requested AI content. The Service does not train or maintain personalized AI models tied to individual users.
2. Eligibility
The Service is not intended for individuals under the age of 16. By using the Service, you represent and warrant that you are at least 16 years old and have the legal capacity to enter into these Terms.
3. User Content and Content Policies
3.1 User Content
"User Content" means any text, images, audio files, voice recordings, or other materials submitted to the Service.
You represent and warrant that:
You own or have all necessary rights, licenses, and permissions to upload and use the User Content.
You do not upload images or audio of other individuals without their explicit consent.
Your User Content does not violate any applicable laws or third-party rights.
Uploading illegal, offensive, infringing, or otherwise prohibited content is strictly prohibited. We reserve the right to remove User Content or suspend accounts that violate these Terms.
3.2 File Guidelines
Audio Files: Maximum file size of 20 MB per upload.
Images: Images may be uploaded solely for the purpose of generating AI content. Uploaded images must depict the user or content the user has the legal right to use.
4. Subscriptions, Credits, and Payments
4.1 Subscription Plans
Certain features of the Service are available only through paid subscription plans. Plan details, pricing, included credits, and billing frequency are displayed at the time of purchase.
Subscriptions are billed in advance on a recurring basis and automatically renew unless cancelled prior to the renewal date.
4.2 Credits System
The Service operates on a credit-based system. Credits are required to generate AI content and access certain features. Credits may be obtained through subscription plans or by purchasing standalone credit packs.
Credits are non-transferable and may only be used within the purchasing account.
4.3 Credit Expiration and Usage Order
Subscription Credits: Credits included with a subscription plan may expire at the end of the applicable subscription period or as otherwise disclosed at purchase.
Purchased Credit Packs: Credits purchased as standalone packs do not expire.
Usage Priority: When both expiring and non-expiring credits are available, credits with an expiration date are used first.
The expiration of subscription-based credits does not constitute a refund entitlement.
4.4 Payment Processing
Payments are processed by our third-party payment provider, Stripe Payments Europe, Ltd. or its affiliates ("Stripe"). We do not store or process full payment card details. Subscription management, renewals, cancellations, and payment processing are handled by Stripe in accordance with its own terms and privacy policies.
By purchasing a subscription or credits, you also agree to Stripe’s applicable terms and privacy policy.
4.5 Cancellations and Refunds
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Fees paid are non-refundable except where required by applicable law.
5. Data Handling and Privacy
5.1 Data Collection
We may collect and process the following categories of personal data:
Uploaded images and audio files used to generate AI content
Voice recordings
Text inputs and commands
Account identifiers (such as user ID, username, and email address)
Generated AI content
Usage data (such as timestamps, logs, and feature usage)
5.2 Purpose of Processing
Personal data is processed for the following purposes:
Providing and operating the Service
Generating AI content at your request
Improving, securing, and maintaining the Service
Customer support and communications
Compliance with legal obligations
5.3 Legal Basis
We process personal data based on one or more of the following legal grounds:

Legitimate interests, including service improvement and security
5.4 Data Retention
Personal data is retained only as long as necessary to fulfill the purposes described above. Typically, data is retained for up to one year after your last interaction with the Service, unless a longer retention period is required by law.
You may request deletion of your personal data at any time.

Payment service providers: Stripe acts as an independent data controller for payment-related data.

6. Intellectual Property
6.1 User Content Ownership
You retain ownership of your User Content. By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and reproduce such content solely for the purpose of providing the Service.
6.2 AI-Generated Content
Ownership of AI-generated content may depend on applicable law. We grant you a non-exclusive, worldwide, royalty-free license to use, reproduce, distribute, and display AI-generated content for personal and commercial purposes, subject to these Terms.
You are solely responsible for ensuring that your use of AI-generated content complies with applicable laws and does not infringe third-party rights.
6.3 Service Intellectual Property
All rights, title, and interest in the Service, including software, algorithms, and infrastructure, are owned by DEEPWERK or its licensors. No rights are granted except as expressly stated.
7. Acceptable Use
You agree not to use the Service to:
Violate any laws or regulations
Infringe intellectual property or privacy rights
Generate illegal, harmful, or deceptive content
Circumvent usage limits, security measures, or billing systems
8. Disclaimers and Limitation of Liability
8.1 Disclaimers
The Service is provided "as is" and "as available." We make no warranties regarding accuracy, reliability, or non-infringement of AI-generated content.
8.2 Limitation of Liability
To the maximum extent permitted by law, DEEPWERK shall not be liable for indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Service.
8.3 Indemnification
You agree to indemnify and hold DEEPWERK harmless from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.
9. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
